MYLAND LIMITED TERMS & CONDITIONS - as at 11 November 2024.
Please read the following terms and conditions carefully. These terms and conditions apply to your retreat booking with Myland Limited (We or Myland & Co). By making your booking you are agreeing to these terms and conditions.
PRICES
Prices are quoted in New Zealand dollars and inclusive of GST.
All retreat prices are subject to availability and can be withdrawn or varied by us for any reason without notice prior to booking and payment.
PAYMENT
Full payment is required upon booking.
CANCELLATION
If you are no longer able to make the retreat you have booked, and you let us know 4 weeks or more prior to the retreat date, you will be entitled to a full refund or credit note.
If you cancel within 4 weeks of the retreat date, you will be entitled to a credit note.
You are welcome to transfer or gift your ticket to a friend or family member, so long as you notify us within 48 hours of the retreat start time. Please let us know so we can update their details before the retreat.
MODIFICATION OR CANCELLATION OF A RETREAT BY MYLAND & CO.
We will use all reasonable endeavours to run our retreats as advertised, but we reserve the right, in our absolute discretion, to modify or cancel a retreat for any reason including due to unforeseen circumstances, such as retreat facilitator or venue unavailability. When a retreat is cancelled by Myland & Co. you will receive a refund or credit note.
We are not responsible for any incidental or consequential loss that you may have incurred as a result of such a change or cancellation (like non-refundable flights, or non-refundable accommodation).
CREDIT NOTES
All credit notes issued by us are valid for use for 12 months from the date of issue. The credit note will be of the same value in which you paid.
HEALTH AND SAFETY
For your safety, you must disclose to us if you are or may be pregnant, and if you have any physical or mental conditions or food allergies, which may impact your enjoyment of the retreat experience (including if your health changes after your booking is made).
You are required to complete a Retreat Registration Form in which you must declare any relevant health, medical, or dietary issues or requirements. This form is required at least two weeks prior to the retreat date.
You are wholly responsible for your own health and safety at all times during the retreat. You are free to stop or decline participating in any activity for any reason, at any time.
Myland & Co. crew members (retreat facilitators, experience managers, activity guides etc) will at all times have the final say on all matters related to the safety and wellbeing of guests on our retreats. We reserve the right to prohibit any guest from participating in an activity or continuing with the day with no right of refund, if we deem the guest is posing a threat to themselves, or the safety or enjoyment of others.
FOOD AND BEVERAGE
You must inform us of any dietary requirements on your Retreat Registration Form. While we will use endeavours to accommodate these requirements we do not guarantee that we will do so.
WEATHER INTERRUPTIONS
The weather can affect outdoor activities, scenic views, or even cause cancellations. In a situation where the weather alters the Myland & Co. experience, Myland & Co reserves the right to cancel, reschedule, or modify the retreat. In the case of cancellation by us, we will issue you with a refund or credit note.
PRIVACY
By booking with us you acknowledge that we will collect, use, and disclose your personal information to our third party service providers and Myland & Co. wellness practitioners. For any purposes relating to our retreats. You have a right to access and correct your personal information held by us. If you would like to request access or correction to your personal information please contact us at hello@myland.co.nz.
We may have photographers and videographers documenting our retreats. These images may be used in any of our promotional materials, website, and social media platforms unless guests have specifically requested to the photographer or in writing to us to not use any material their image is depicted in. Otherwise, permission is granted to us to use such images for publicity and promotional purposes - without payment or attribution.
AGE
Due to the types of activities undertaken on our retreats, you must be 16 years of age and over to participate.
LIMITATION OF LIABILITY
You agree, to the maximum extent permitted by law Myland & Co. its retreat facilitators or third-party service providers, will be liable to you, whether in contract, tort, or otherwise for any loss, damage, or injury arising directly or indirectly from any Myland & Co retreat, or any good or service supplied or provided by Myland & Co.
GOVERNING LAW
These terms and conditions shall be governed by the laws of New Zealand and the parties submit to the jurisdiction of the courts in New Zealand.
VARIATION
We may amend these terms and conditions at any time. The latest terms and conditions can be found on the Myland & Co. website.
